PERMISSIONS!

If you have arrived here, I have probably either taken your picture or asked to take your picture. In order for me to continue publishing pictures in my online photo gallery I need permissions:
1) Property Owner's Permission
2) Your Permission
3) Permission of the ISP
4) Permission of the Host Provider
5) News Worthy Events
Juggling all these "Permissions" can take time and require following differing rules in different locations or even different times at the same location. Bottom line, I may ask that you sign a release before I take a picture. Even if I have photographed you many times, I may ask for a release.
I do take pictures on request but do not guarantee to publish them. If I find that an image is unsatisfactory; unsuitable; injurious to the you or the property owner; or you are not legally authorized to give permission, I will not publish the image. Legal - means at least 17 but I will expect over 18. If you look exceptionally young, I may not only ask for proof of age but may require a signed release. We share the world with people of very narrow view points aggressively looking for ways to stop our fun and punish perceived or imagined transgressions.
A RANT
Grabbing/Yanking my clothing and screaming at me is not the best way to get a nice flattering image published.
If you like to show it all, arrange for a private session. In public keep your privates covered. Males your pants zipped. Females your breasts covered. Both keep em both covered.
OK - I finished my rant. This site is for fun and enjoyment for both you and me. Please help keep it that way.
PROPERTY OWNERS
I need the permission of the property owner because private property is just that private. There is no unlimited right of access to business property. Bars, Clubs, Pool Parties, Restaurants are still private property. The owner can say no and make it stick. The owner expects to operate at a profit and stay in business. While you and yours may pack up and move to a new city or a new state, a building is not so easily moved let alone an entire business with licenses and employees. The business operator has an obligation to provide a safe environment free of harassment. The terms are not clearly defined and often change meaning with the wind. Under some circumstance the business operator is legally required to protect you from from yourself. All this and keep you the customer happy, comfortable, and safe. Unhappy customers don't spend money, don't return, can file complaints, even start legal actions.
YOU
I request your permission first and foremost because I don't wish to invade your privacy. Technically any one can take a picture for private usage but that can make for some very unhappy, even angry, people and property owners. I am not interested in making people upset or angry. Just because I love taking pictures does not mean the rest of the world is comfortable being photographed or agreeable to being photographed.
When you request that I take you picture, I will assume that you agree to having it put online unless you ask that it be a private picture. I will not be offended by your occasional request. If, you request that a picture be private, the image file is marked as private and will not be published but you might still be able to obtain a copy for your personal usage. ASK
Posting of images online is delayed for 2 reasons: (1) After a long weekend I am tired and fuzzy eyed, (2) You have time for second thoughts and time to send me an e-mail requesting that you not appear online or call me on my cell phone in the evenings. I do have a daytime job that expects my undivided attention to work, so If I ask you to call back later it is not personal.ISP
I have legal contractual obligations to my ISP provider. Contracts have been signed and local, state, and federal laws are involved. You have similar obligations at your end. If you are online from a School, Business, or Public Connection they have legally enforcible rules and obligations. We do not have an unlimited guaranteed right to Internet access.
HOST PROVIDER
The Hosting Site/Company has legal limits on what they may or may not allow on their equipment. They are at least partially responsible to monitor/control their systems. So I must meet their system requirements or move my web pages elsewhere.
NEWS WORTHY EVENT
If you are involved in a "News Worthy" event, entirely different legal and ethical rules apply. Permission rules change as do publishing rules. You should assume you will be published some where, some time. Lots of very grey areas.
